Terms of Service

1. Acceptance of Terms

By accessing or using SommApp ("the Service"), operated by Three Elements Design, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SommApp is a web-based application for creating, organizing, and sharing structured wine tasting notes. The Service is available as a progressive web app at app.sommapp.com and may be accessed from any modern browser.

3. Accounts

You may browse the app in demo mode without an account. To save notes and access full features, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials.

4. User Content

You retain ownership of all tasting notes and content you create. We do not claim any intellectual property rights over your content. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

5. Data Portability

Pro subscribers receive quarterly data exports via email, including plain-text and JSON formats of their tasting notes. You may request a full export of your data at any time.

6. Subscriptions & Billing

The Free plan is available at no cost with limited features. Paid plans (Pro, Libraries) are billed according to the pricing displayed at the time of purchase. Prices may change with 30 days' notice. You may cancel your subscription at any time; access continues through the end of the current billing period.

7. Acceptable Use

You agree not to misuse the Service, including but not limited to: attempting to access other users' data, reverse-engineering the application, using the Service for any unlawful purpose, or interfering with the Service's operation.

8. Availability & Offline Use

We strive to keep the Service available and reliable, but do not guarantee uninterrupted access. The app supports offline use; notes created offline will sync when connectivity is restored. We are not responsible for data loss resulting from extended offline periods or device failures.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Three Elements Design, LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify registered users of significant changes via email.
